Legal papers relating to the sale of Herne Bay windmill.

An array of legal correspondence, papers, drafts and accounts associated with the parties to the sale of the windmill at Herne Bay in July 1879. The papers date between 13 July 1878 to 16 October 1880 and relate to: correspondence regarding the payment of succession duty on the deaths of Henry Stanley and James Alexander; a dispute as to responsibility for paying for the previous miller's fixtures (the miller, Thomas Wootton having been given notice to quit upon the sale of the windmill); ascertaining details as to the birth and death dates/ burial locations of various members of the Alexander family and other individuals previously having an interest in the mill (such as Edward Charles and Henry Stanley); queries regarding progress on the administration of James Alexander's estate. Some of the correspondence from the Alexander family is written on black-edged mourning paper.

Will of Edward Charles relating to a windmill at Herne Bay

1 page of paper measuring 44 cm x 33 cm and folded in two comprising a copy of the will of Edward Charles in which he makes various bequests to his children, Charles, Edmund and Eliza. His bequest to his daughter of the "mill bake house lodge stable and premises situate in the Parish of Herne" is made to her "for her sole and separate use free from marital control". Earlier references in the will are to bequests being made to Eliza "for her own sole & separate use and benefit absolutely without being in any manner subject to the debts engagements or control of any husband with whom she may happen to intermarry".

Agreement for the sale of Herne Bay windmill.

One piece of paper measuring approximately 33 cm x 41 cm, folded in two, and recording the agreement between the eight Alexander brothers (Joseph and James, both farmers of Lower Garrington, Littlebourne acting as agents for the others) to sell the windmill at Herne Bay to Joseph William Horne "otherwise William Collard," licensed victualler of Richmond Inn, Herne Bay. The property sold comprises, "all that windmill and all that messuage or tenement and bakehouse with the outbuildings thereunto belonging and the land adjoining thereto situate lying and being at Herne Bay..... late in the occupation of Alfred Taylor and now Thomas Wootton Together with all the machinery tackle fixtures fittings and gear in and about the said windmill....". The agreement provides for the vendors who inherited the property from their late father, James Alexander, as "coheirs in gavelkind", to provide an abstract of title tracing ownership back to Edward Charles of Reculver.

Solicitor's papers, drafts and accounts relating to the sale of "a freehold house windmill land at Herne Bay" by the Alexander family to "Horne otherwise Collard". The documents include: a very clear schedule of "title deeds & writings relating to a messuage windmill land & hereditaments at Herne Bay in the County of Kent"; the Alexander family's solicitor's draft responses to requisitions on title raised by the purchaser's solicitor, Walter Furley of Canterbury; the cash account of the Alexander family's solicitors (Emmerson & Co of Sandwich), showing the shares received by each of eight Alexander brothers and the succession duty paid;

Abstract of title to a windmill and bakehouse at Herne Bay

12 pages of paper measuring approximately 41 cm x 34 cm tracing brothers, Charles and Edmund Charles', title as 'coheirs in gavelkind' to the property of their sister, Elizabeth Stanley, who died without issue in 1868. The document traces title back to the purchase of land by Edward Charles and John Thorp[e] from Sir Henry Oxenden 'upon which they had lately erected and built a Windmill' and to an additional parcel of land 'part of the waste of the Lord of that [Reculver] Manor' and to which they were admitted as tenants on 20 October 1824. The document recites that Edward Charles and John Thorp[e] had 'for sometime then past carried on the trade or business of Millers jointly and in copartnership at [the] parish of Herne' but that in July 1829, had decided to dissolve the partnership. Having agreed that Edward Charles should buy John Thorp[e]'s share (including the windmill and all fixtures, machinery and stock-in-trade), two arbitrators were appointed to make final Awards as to valuation (one of whom being John Penn, millwright, of Deptford). Edward Charles' will of 23 August 1850 describes him as residing at Reculver Villa. Dispositions under the will include the Herne Bay mill and bakehouse in favour of his sons Edward and Charles and his daughter, Eliza. Further recitals are made as to the settlement reached regarding Eliza's entitlements under her father's will upon her marriage to Henry Stanley of 25 Upper Gloucester Place, Dorset Square, London.

Inland Revenue form for Succession Duty payable upon the death of James Alexander.

Inland Revenue pre-printed form completed by Joseph Alexander on behalf of himself and his seven brothers, having inherited their father's estate as coheirs in gavelkind, their father, James Alexander having died intestate on 24 August 1875. The estate is valued at £1,400 and is described as "a freehold messuage or tenement and Windmill with the buildings and Land thereunto belonging situate at Herne Bay in the parish of Herne in the County of Kent in the occupation of Thomas Wootton at the yearly rent of £56.". A Succession Duty of £8 and six shillings is paid.

Abstract of title to a windmill at Herne Bay

14 pages of paper measuring approximately 34 cm x 41 cm abstracting the title of the 'coheirs of James Alexander deceased to a messuage Windmill & Land situate at Herne Bay in the Parish of Herne in the County of Kent'. The abstract concerns dealings with the property between 1808 and 1835.

Letter enclosing a plan showing the location of the Herne Bay windmill.

A solicitor's letter from Walter Furley (acting for the purchaser of the windmill, William Collard/Thorne) to Emmerson & Co (acting for the vendors, the Alexander family) enclosing a "plan on Deed of 1824" and showing the location for the land upon which the windmill was later built. The plan has a pin hole, presumably from where it was attached to the 1824 deed, and measures 18 cm x 13 cm.

Solicitor's papers, drafts and accounts relating to the Alexander family's instructions to sell their 'family property' at Herne Bay for £1,400 to Mr Collard 'alias Horne'. The papers include a draft 'Schedule of Title Deeds and Writings relating to a messuage Windmill and lands at Herne Bay' dating from 1824 through to 1879, the property having been sold by the Charles brothers (Edmund and Charles) and Henry Stanley (Eliza's widower) to [James] Alexander on 31 August 1869. The firm of solicitors is Emmerson & Co, Sandwich, Kent.

5 pages of paper measuring approximately 41 cm x 34 cm describing Sir James Oxenden's settlement of his estate at Hearn Bay including land known as 'Underdown with one other small messuage or tenement and the Barns stables orchards Gdens & Arable Meadow and Pasture Lands...... containing in the whole by estim[ation] 160 acres more or less....And all other messuages etc sit[uate] lying & being in the Parishes of Reculver Hearn and Chislett....".
